Alternative Dispute Resolution

San Francisco, California Alternative Dispute Resolution

Many business and employment contracts stipulate that disputes are resolved through alternative dispute resolution. If you are to have any chance of success in your employment or contract dispute, you should retain a lawyer that is well-versed in ADR. Our attorneys have over thirty years of litigation experience, including mediation and arbitration cases. To discuss your legal needs with an experienced mediation attorney, contact the Law Office of Robert M. Lubin.

Our mediation lawyers handle alternative dispute resolution cases that involve the following:

Mediation and Arbitration

Mediation is more informal than arbitration or trial. It involves the two sides negotiating with the help of a mediator. Arbitration resembles a trial, with the two sides presenting their case, and the arbitrator ruling on it.

ADR has several advantages. It is far less costly and time consuming than a trial. It also keeps the proceedings off of the public record.

When our law firm goes to arbitration or mediation, we are no less zealous in defending our clients' interests. At the same time, we are still civil and polite to the other side. If we treat opposing counsel with fairness, we can often negotiate a better result.

In addition to representing clients, Mr. Lubin is on the San Francisco probate mediation list. His experience as a neutral third party gives him unique insight into the ADR process, which he uses on his clients' behalf.

Arbitration
Attorney Robert M. Lubin serves as a neutral third party in arbitration. Binding and non-binding arbitration allows each party involved in a dispute to present evidence before the neutral party. The neutral party makes a decision, which cannot be appealed in binding arbitration but can be appealed in non-binding arbitration.

Mediation
Our lawyers serve as mediators-detached parties with no interests in the outcome of either party's case. Mediation allows disputing parties to reach mutually agreeable solutions to their personal or business disputes. If mediation does not work, you have the right to take your case to court.

Neutral Evaluations
Serving as a neutral evaluator, a lawyer from our firm can examine the cases, fact scenarios and other issues to give clients an opinion. Our firm can offer an early evaluation of the strengths of the case, the weaknesses and potential outcomes.
